Blue Mist Cafe in Sydney’s Bankstown and its operator are in hot water after failing to pay an employee for seven days’ work.
Blue Mist Entertainment Pty Ltd and Cafe Manager Diaa Mohamed will face the Fair Work Ombudsman in court in June for failing to back-pay the worker.
The international student submitted a request to the Fair Work Ombudsman alleging she had not been paid for her work at the Blue Mist Cafe in July 2020.
Fair Work inspectors issued a compliance notice to Blue Mist Entertainment in September after finding the worker was owed minimum wages and penalty rates for weekend work.
The Ombudsman alleges the company failed to comply with the notice and that Mohamed was involved with the breach.
Blue Mist Entertainment now faces a maximum penalty of $33,000, with Mohamed facing a penalty up to $6,660.
The Ombudsman is also seeking orders requiring the compliance order is addressed, which includes back-paying the worker in full plus superannuation and interest.
